Affiliate Accounts
Commission is paid typically paid monthly, but exact dates may vary. To earn the commission on a sale, the purchase must be made by a person who follows your link with your tracking code to a product on our website. RMCybernetics is not responsible for missed payments due to incorrect links, delayed purchases, problems with our website or server, or any other reason.
Disclaimers and Limitation of Liability
We do not guarantee uninterrupted or error-free access to this website, or that the website or its server will be free of viruses. This does not limit our obligations for goods, custom devices, software or services you purchase from us.
For consumer purchases, we are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for loss caused solely by misuse or modifications for which we are not responsible, or business losses arising from products supplied for private use.
We do not exclude or limit liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, your statutory remedies for faulty or misdescribed goods or inadequate services, or any other liability that cannot lawfully be excluded or limited.
Custom Electronics & Consultancy Services
For custom designs, a payment in advance is required. A minimum of 50% is required before work can commence with the remaining to be paid prior to shipping once the work is completed. Goods made to your specifications or personalised, including goods cut to a length you specify, cannot be cancelled or returned simply because you change your mind. This does not remove your rights if goods are faulty or misdescribed. Cancellation of design and consultancy services is governed by the agreed project terms and any applicable statutory rights; any cancellation charge must be lawful. Any customer requesting changes to the design or project after work has commenced will incur additional charges. For complex and long term projects, it is possible for costs to rise as the project continues. These additional costs must be paid in order to complete the project. Guaranteed fixed cost projects are available under contract which must be agreed by all parties.
Delivery / Shipping
International orders shipped with Royal Mail will be picked up in the destination country by the local equivalent national postal service. For example; USPS in the USA. There may be limited tracking information once in the destination country and it is sometimes better to check with the local service if your order is late or missing. If tracking shows delivery but you cannot locate your parcel, please contact us so we can investigate. For consumer orders, goods remain our responsibility until you, or a person you have identified to receive them, take physical possession, except where the law provides otherwise. For guaranteed and faster shipping we suggest using the FedEx option.
Returns, cancellations and refunds
Our Returns policy forms part of these terms and sets out the cancellation deadlines, return procedure, return postage, condition requirements and refunds for goods. It covers eligible UK and European Union consumer purchases and the exclusion for custom-made, personalised and customer-specified cut-to-length goods.
We do not offer an extended change-of-mind return period. Where no statutory right to return applies, any exceptional return must be agreed with us in writing before it is sent; the agreed conditions apply only to that discretionary return.
Please include your order details with returned goods. Our return address is: The Returns Department, RMCybernetics, 31 Lawton Road, Alsager, Cheshire, ST7 2AA, United Kingdom. An RMA number or original packaging is not a condition of exercising statutory rights.
We inspect returned goods. Repairs for damage caused by misuse or modification may be chargeable, with your agreement. A modification does not automatically remove statutory rights for an unrelated fault.
If a parcel is returned to us as undeliverable, we will contact you about redelivery or cancellation. Any refund and delivery charges will be handled under the Returns policy and applicable law. A statutory right to a standard delivery-cost refund is not excluded merely because a parcel was returned undelivered.
General
If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
These terms are governed by the laws of England and Wales. If you are a consumer, this does not deprive you of any mandatory consumer protections that apply under the law of your country of residence.
